Analysis of the ICJ’s decision on the Alleged Violations of Sovereign Rights and Maritime Spaces in the Caribbean Sea (Nicaragua v. Colombia)

The panel will analyze the recent decision issued by the International Court of Justice in the case concerning Alleged Violations of Sovereign Rights and Maritime Spaces in the Caribbean Sea (Nicaragua v. Colombia), where the Court decided: (i) Nicaragua’s allegation that Colombia had breached its sovereign rights and jurisdiction in Nicaragua’s exclusive economic zone, as defined by the judgment rendered by the Court in 2012 in the case concerning Territorial and Maritime Dispute (Nicaragua v. Colombia); and (ii) Colombia’s counter-claim regarding Nicaragua’s alleged infringement of the traditional fishing rights of the inhabitants of the San Andrés Archipelago, and the alleged unlawfulness of Decree No. 33-2013, which established straight baselines to connect a series of maritime features appertaining to Nicaragua and that had the effect of pushing the external limit of its territorial sea far east of the 12-mile limit permitted by international law.
