The Silala case (Chile v. Bolivia) and the relevance of ICJ decisions in international investment arbitration [1]

Description: 

On December 1, 2022, the International Court of Justice issued a judgment in the dispute between Chile and Bolivia over the Status and Use of the Waters of the Silala. The decision addressed issues such as the definition of legal dispute, claims without object, and hypothetical questions. The panel will analyze the ICJ's decision and will discuss how international investment tribunals have addressed the same issues in investor-State arbitration. Also, the panel will analyze other decisions rendered by the ICJ and their relationship with investment arbitration.

This session is organized by the ASIL Latin America Interest Group (LAIG).
