Corruption corrodes the social fabric of society. It undermines people’s trust in the political system, in its institutions and its leadership. Bribery in public contracting is a serious problem. More and more parties attempt to reject the jurisdiction of arbitral tribunals on the ground that the contract at issue is tainted by corruption. This type of allegations have an impact on the admissibility of claims as well as on the merits. They also pose important questions on international and domestic public policy and the relationship of civil or private adjudication with the criminal justice system. This event will discuss how judges and arbitral tribunals handle allegations of corruption in international and domestic commercial cases.
